Terms of Service

1. Agreement and acceptance

These Terms of Service (“Terms”) are a binding agreement between you and AAPASTECH PRIVATE LIMITED, a company incorporated in India (CIN U72900DL2022PTC395508, registered office: Roop Nagar, Delhi 110007, India) (“Aapastech”, “we”, “us”), operating the Tyashin product (the “Service”). By checking the acceptance box at sign-up, by accepting an updated version when prompted, or by using the Service, you accept these Terms in full. If you use the Service on behalf of a business, you represent that you are authorized to bind that business, and “you” includes it. If you do not accept these Terms, you must not use the Service.

2. The Service

Tyashin is an AI-assisted content platform that researches, drafts, schedules and publishes social-media content — including text and AI-generated images — to accounts and pages you connect (currently LinkedIn). The Service uses third-party artificial intelligence models and the APIs of third-party platforms. Features, models, quotas and outputs may change, be interrupted, or be withdrawn at any time without notice.

3. Your account

You are responsible for your account credentials, for all activity under your account, and for keeping your connected social accounts in good standing. You must be at least 18 years old. You must provide accurate information and keep it current.

4. Authorization to act on your behalf

By connecting a social account or enabling scheduling, auto-generation or auto-posting features, you grant Aapastech an express authorization and licence to act on your behalf, including to: access your connected accounts through their official APIs; generate, store and modify content (including text, images and other media) for you; schedule and publish such content to your connected accounts and pages; and retrieve related account, page and performance data. Actions taken by the Service under this authorization are deemed your actions. You may withdraw this authorization at any time by disconnecting the relevant account or disabling the relevant feature; withdrawal does not affect actions already taken.

5. Content, AI outputs, and your duty to review

As between you and Aapastech, you own the content published to your accounts through the Service, and you grant us a worldwide, non-exclusive, royalty-free licence to host, process, reproduce, modify and transmit content and related data as needed to operate, secure and improve the Service.

You acknowledge that AI-generated outputs (text and images) are produced by automated systems and may be inaccurate, incomplete, outdated, or may unintentionally resemble third-party material. Every output is a draft prepared for you. It is solely your responsibility to review, edit, verify and approve all content — including content published automatically under settings you have enabled — before or through its publication, including verifying that it does not infringe any third party’s copyright, trademark, publicity, privacy or other rights, and that it is accurate, lawful and appropriate for your audience. All validation of privacy, copyright, trademark and other intellectual-property compliance rests with you, and published content is published in your name and at your sole responsibility and liability, not that of Tyashin or Aapastech.

Any brand assets you upload (logos, images, text) must be owned by you or licensed to you. Similar outputs may be generated for other users; we do not warrant exclusivity or availability of intellectual-property protection for AI-generated outputs in any jurisdiction.

6. Credits and billing

Paid features consume your plan’s AI usage allowance (“credits”). Text generation, research, quality review and image generation all consume credits at rates shown in the product, which we may update. When your credits are exhausted, the Service stops generating new content (manually and automatically) until credits renew or you purchase an extension. Credits consumed are non-refundable, including where you choose not to use, or reject, generated output. Subscriptions renew and are charged per the plan terms shown at purchase; taxes may apply. Except where required by law, payments are non-refundable. We may change pricing prospectively with notice via the Service.

7. Acceptable use

You must not use the Service to create or distribute content that is unlawful, deceptive, defamatory, infringing, harassing or spam; to violate the terms, policies or rate limits of any connected platform (including LinkedIn); to misrepresent identity or affiliation; or to reverse-engineer, resell or abuse the Service. We may throttle, suspend or terminate accounts engaged in abuse.

8. Third-party platforms

The Service depends on third-party platforms and AI providers that we do not control. LinkedIn is a trademark of LinkedIn Corporation; Tyashin is an independent product not endorsed by or affiliated with LinkedIn. Your use of connected platforms remains governed by their own terms, and you are solely responsible for compliance with them. We are not responsible for actions taken by any platform with respect to your accounts, including content removal, restrictions or suspension, or for outages, API changes or data handling of any third-party provider.

9. Indemnification

You will defend, indemnify and hold harmless Aapastech, its directors, officers, employees and agents from and against any claims, demands, proceedings, losses, damages, fines, and expenses (including reasonable legal fees) arising out of or related to: (a) content generated for you or published through your account; (b) your use of the Service or connected platforms; (c) your breach of these Terms; or (d) your violation of any law or any third party’s rights, including intellectual-property, publicity and privacy rights.

10. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT ANY BUSINESS OUTCOME, REACH, ENGAGEMENT OR FOLLOWER GROWTH.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) AAPASTECH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL OR DATA; AND (B) AAPASTECH’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Suspension and termination

You may stop using the Service and cancel at any time. We may suspend or terminate access (wholly or partly) for breach of these Terms, legal or platform-compliance risk, non-payment, or discontinuation of the Service. Sections 5, 9, 10, 11, 13 and 14 survive termination.

13. Changes to these Terms

We may update these Terms from time to time. Material updates are versioned and will be presented for acceptance in the product; continued use after acceptance of, or after reasonable notice of, an updated version constitutes agreement to it. The version in effect is the one most recently accepted by you or published here.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer-law rights in your jurisdiction, the courts at New Delhi, India have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
